Acceptable Use and Network Management Policy of Home TeleNetworks, Inc.
By using Service(s) provided by Home TeleNetworks, Inc., and its affiliates or subsidiaries (all hereafter referred to as “HomeTel”), you ("Customer") agree to comply with this Acceptable Use and Network Management Policy (“AUP”).
Introduction:
The purpose of this AUP is to inform our customers of our expectations regarding their use of the Internet through the HomeTel Network. It is binding on all users of the HomeTel Network. This policy should be read in conjunction with the HomeTel Internet Access Agreement, the HomeTel Abuse Policy, the HomeTel Privacy Policy, and all other policies published by HomeTel. This AUP may be revised from time to time, and your use of HomeTel's Service(s) after changes are posted on HomeTel's web site at http://www.hometel.com/internet/policies/ shall constitute your acceptance of any changes or additional terms. The HomeTel AUP is designed to help protect HomeTel's assets, the assets of its Customers, and the Internet community, from irresponsible or illegal activities of HomeTel Customers or their Users. These activities may disrupt or degrade HomeTel Services, pose a threat to HomeTel's assets, expose HomeTel (or other providers of Internet Services) to claims of civil or criminal liability or other legal sanctions. Moreover, because of various conventions used in the industry (including blocking, filtering and blacklisting) these activities may impair HomeTel's ability to interconnect with other providers of Internet Service. These activities may relate to the content stored or transmitted by Customers or their Users or to the nature of the transmissions themselves such as sending large numbers of unsolicited messages (Spam). Customers are responsible for avoiding the prohibited activities and strictly following the AUP terms set forth herein.
HomeTel commits to the open and non-discriminatory use of the Internet by its customers and commits to use reasonable network management practices to ensure an open Internet. HomeTel will manage its network and provide access in accordance with the Federal Communications Commission’s (FCC’s) Open Internet Rules (adopted December 21, 2010 in 25 FCC Rcd 17905) and in compliance with any future rules adopted by the FCC.
Transparency:
HomeTel shall make available public information on its website (http://www.hometel.com/internet/policies/) regarding its network management practices, performance and commercial terms of its service sufficient for consumers to make an informed choice regarding their use of such services. HomeTel will not unjustly or unreasonably prevent or interfere with competition among Content, Applications, Service, or Device Providers.
AUP Coverage:
This HomeTel AUP applies to the Services that provide (or include) access to the Internet, Services provided over the Internet, and Hosting services (collectively "IP Services"). Customer is responsible for the actions of all others who may be using the IP Service(s) under Customer's account. It is Customer's obligation to take whatever measures are necessary to protect access to a Customer account. This may include, but is not limited to, the protection of passwords. If a Customer or its User(s) violate the AUP, HomeTel may, depending on the nature and severity of the violation, suspend or terminate service, as specified below. Customer may have access through the HomeTel Network(s) and Service(s) to search engines, subscription web services, chat areas, bulletin boards, web pages, USENET, or other services that promulgate rules, guidelines or agreements to govern their use. Failure to adhere to any such rules, guidelines, or agreements shall be a violation of this AUP.
AUP Enforcement and Notice:
Customer's failure to observe the guidelines set forth in this AUP may result in HomeTel taking actions, anywhere from a warning to a suspension of privileges or termination of your Service(s). HomeTel reserves the right, but does not assume the obligation, to strictly enforce the AUP. When feasible, HomeTel may provide Customer with notice of an AUP violation via e-mail or otherwise, and demand that such violation be immediately corrected. However, HomeTel reserves the right to act immediately and without notice to suspend or terminate IP Service(s) in response to a court order or other legal requirement that certain conduct should be stopped or when HomeTel determines, in its sole discretion, that the conduct may: (1) expose HomeTel to sanctions, prosecution, civil action or any other liability, (2) cause harm to or interfere with the integrity or normal operations of HomeTel's network(s) or facilities, (3) interfere with another person's use of HomeTel's IP Service(s) or the Internet, or (4) otherwise present a risk of harm to HomeTel or HomeTel Customers, or other parties HomeTel interconnects with. HomeTel's decisions with respect to interpretation of the AUP and appropriate remedial actions are final and determined by HomeTel in its sole discretion. HomeTel may refer potential violations of law(s) to the proper authorities, may cooperate in the investigation of any suspected criminal or civil wrongdoing, and will cooperate with authorities when required to do so by law, subpoena, or when the public safety is at stake. HomeTel assumes no obligation to inform Customers that their information has been disclosed, and, in some cases, may be prohibited by law from providing such notice. HomeTel does not, as an ordinary practice, proactively monitor the activities of those who use its IP Service(s) or exercise any editorial control over any material transmitted, hosted or posted using IP Services to ensure that its Customers comply with the AUP and/or the law, although it reserves the right to do so. If HomeTel is alerted to violations, or potential violations, of this AUP, HomeTel will take whatever measures it deems necessary and appropriate to stop or prevent such violations, including the actions described in this AUP. For example, HomeTel may in its sole discretion refuse to transmit, screen, or edit content prior to delivery of the IP Service(s), block access to certain categories of numbers or certain sites as HomeTel determines needed to enforce these policies. If Customer’s Service is suspended or terminated for any AUP violation, Customer must get written approval from HomeTel’s Policy Management Department (to reactivate service, or order new service. HomeTel may, in its discretion, decline to reinstate Customer’s Service. If HomeTel’s Policy Management Department approves Customer for reinstatement or new service, set-up fees, reactivation fees or deposits may apply. If HomeTel discovers that Customer has renewed Service, or ordered new Service, following termination for an AUP violation without the prior written consent of the HomeTel Policy Management Department, HomeTel may terminate your Service without further notice. In such case, Customer is responsible for any applicable early termination charges. HomeTel will not issue any refunds, credits or other forms of compensation for the period when IP Service(s) have been suspended as a result of violation(s) or alleged violation(s) of this AUP. HomeTel shall not be liable for any damages of any nature suffered by any Customer, User, or third party resulting in whole or in part from HomeTel 's exercise of its rights under this AUP.
Network Security:
HomeTel uses generally accepted technical measures to provide acceptable service levels to all customers, such as application-neutral bandwidth allocation, as well as measures to address service attacks, illegal content and other harmful activities to protect network integrity and reliability.
Prohibited Actions:
Customer may not use the Service in a manner that violates any applicable local, state, federal or international law, order or regulation. Additionally, the customer may not use the HomeTel IP Services to:
· Conduct, participate in, or otherwise facilitate pyramid or other illegal soliciting schemes.
· Take part in any fraudulent activities, including impersonating any person or entity or forging anyone else's digital or manual signature.
· Invade another person's privacy, stalk, harass, or otherwise violate the rights of others.
· Post, transmit, or disseminate content that is illegal, threatening, abusive, libelous, slanderous, defamatory, promotes violence, or is otherwise offensive or objectionable.
· Restrict, inhibit, or otherwise interfere with the ability of any other person to use or enjoy the equipment or the Service, including, without limitation, by posting or transmitting any information or software which contains a virus, lock, key, bomb, worm, Trojan horse, Cancelbot, or other harmful feature.
· Collect or store personal data about other users.
· Use an IP address not assigned to the Customer.
· Violate any other HomeTel policy or guideline.
· Resell or redistribute the Service to any third party via any means including but not limited to wireless technology.
Unlawful Activities:
HomeTel IP Services shall not be used in connection with any criminal, civil or administrative violation of any applicable local, state, and provincial, federal, national or international law, treaty, court order, ordinance, regulation or administrative rule. By using the HomeTel IP Service(s), Customer represents and warrants to HomeTel that Customer (and its Users) are not resident(s) of any country, or affiliated with, any other organization prohibited to do business within the United States as defined by the Office of Foreign Assets Control within the United States Department of the Treasury.
Intellectual Property:
You are prohibited from infringing, publishing, submitting, copying, uploading, downloading, posting, transmitting, reproducing, or distributing software, video or audio content, or any other material that is protected by copyright, trademark, patent, trade secret, any other type of intellectual property rights, trademark laws (by rights of privacy or publicity) or other proprietary right of any party unless you own or control the rights thereto or have received all necessary consent to do the same. This prohibition includes the use of any material or information including images or photographs that are made available through any HomeTel site or Service(s). For more information about HomeTel's copyright protection practices under the Digital Millennium Copyright Act (DMCA) of 1998 or for information on how to contact HomeTel's DMCA agent, please contact HomeTel’s Policy Management Department whose contact information is listed below.
Offensive or Threatening Material or Content:
HomeTel IP Services shall not be used to host, post, transmit, or re-transmit any content or material that is threatening, harassing, obscene, indecent, hateful, malicious, racist, fraudulent, deceptive, invasive of privacy or publicity rights, abusive, inflammatory, or otherwise harmful or offensive to third parties, treasonous, excessively violent or promotes the use of violence, or provides instruction, information or assistance in causing or carrying out violence against any government, organization, group or individual, or provides guidance, information or assistance with respect to causing damage or security breaches to HomeTel's Network or to the network of any other IP Service provider. Customer shall not create or attempt to utilize a domain name that is fraudulent, indecent, offensive, deceptive, threatening, abusive or harassing.
Interaction with Minors:
HomeTel has a zero tolerance policy regarding use of its Service to engage in inappropriate conduct with a minor (anyone under 18 years of age). You shall not knowingly collect or solicit personal information from a minor without the express consent of the parent or guardian of the minor, nor shall you use this Service to harm or intimidate a minor. HomeTel complies with all federal and state laws pertaining to the protection of minors.
Spam/E-Mail/Usenet/Blog/Social-Networking Abuse:
Violation of the CAN-SPAM Act of 2003, the Electronic Mail Act of Illinois (Public Act 91-0233), or any other state or federal law regulating e-mail services, constitutes an automatic violation of this AUP and HomeTel reserves the right to seek damages and other available relief against Customer, as applicable. Spam/E-mail/Usenet Abuse is prohibited on HomeTel IP Services. Examples of Spam/E-mail/Usenet Abuse include, but are not limited to, the following activities:
· Sending unsolicited electronic mail messages and "mail-bombing" (sending mass unsolicited e-mail messages to a single user, or group of users, commercial or otherwise, or deliberately sending very large attachments to one recipient) using IP Service(s) are prohibited.
· Using another site's mail server to relay mail without the express permission of the site;
· Using another computer, without authorization, to send multiple e-mail messages or to retransmit e-mail messages for the purpose of misleading recipients as to the origin;
· Using IP addresses that the Customer does not have a right to use;
· Collecting the responses from unsolicited electronic messages;
· Maintaining a site that is advertised via unsolicited electronic messages, regardless of the origin of the unsolicited electronic messages;
· Spamming, or sending unsolicited commercial e-mail, sending unsolicited electronic messages with petitions for signatures, or any chain mail related materials, or requests for charitable donations;
· Sending messages that are harassing or malicious, or otherwise could reasonably be predicted to interfere with another party's quiet enjoyment of the HomeTel IP Services or the Internet (e.g., through language, frequency, size or otherwise);
· Sending bulk (i.e., twenty-five or more recipients) electronic messages without identifying, within the message, a reasonable means of opting out from receiving additional messages from the sender;
· Using distribution lists containing addresses that include those who have opted out;
· Sending electronic messages that do not accurately identify the sender, the sender's return address, the e-mail address of origin, or other information contained in the subject line or header:
· Forging headers or identifiers in order to disguise the origin of e-mail;
· Use of redirect links in unsolicited commercial e-mail to advertise a website or service;
· Posting a single message, or messages to online forums or newsgroups, that could reasonably be expected to provoke complaints;
· Posting messages to or canceling or superseding messages on an online forum or newsgroup in a manner that violates the rules of the forum or newsgroup or that contain forged header information;
· Sending bulk electronic messages in quantities that exceed standard industry norms, or that create the potential for disruption of the HomeTel network or of the networks with which HomeTel interconnects;
· Intercepting, redirecting or otherwise interfering or attempting to interfere with e-mail intended for other parties;
· Knowingly deleting any author attributions, legal notices or proprietary designations or labels in a file that the user mails or sends;
· Using, distributing, advertising, transmitting, or otherwise making available any software program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, including, but not limited to, the facilitation of the means to spam.
Spam Damages:
Because spam related damages are often difficult to quantify, in those cases where the actual damages cannot be reasonably calculated HomeTel reserves the right to seek from the Customer liquidated damages in the amount of five dollars (US $5.00) for each piece of 'spam' or unsolicited bulk email transmitted from or otherwise connected with Customer's account, in addition to any other rights and remedies HomeTel might have in contract, law and equity.
Commercial Use:
Customer may not resell or otherwise charge others to use the HomeTel Service. Customer agrees not to use the Service for operation as an Internet service provider, or for any other business enterprise, including, without limitation, IP address translation or similar facilities intended to provide additional access.
Security Violations:
Customer is solely responsible for the security of any device connected to the Service, including any data stored on that device. HomeTel recommends that Customer take appropriate security precautions for any systems connected to the Service. Customer is ultimately responsible for securing any wireless (WiFi) networks connected to Customer’s HomeTel service. Any wireless network installed by the Customer or a HomeTel representative, that is unsecured or "open" and connected to the HomeTel network, will be deemed to be operating as an ISP and subject to the prohibition on Commercial Use set forth above. Customer authorizes HomeTel to use measures to detect unsecured wireless networks associated with your Service.
HomeTel IP Services may not be used to interfere with, to gain unauthorized access to, or otherwise violate the security of HomeTel's or another party's server, network, personal computer, network access or control devices, software or data, or other system, or to attempt to do any of the foregoing. Examples of violations of system or network security include, but are not limited to:
· Intercepting, interfering with or redirecting e-mail intended for third parties, or any form of network monitoring, scanning or probing, or other action for the unauthorized interception of data or harvesting of e-mail addresses;
· Using the Service to breach or attempt to breach the security of another user or attempt to gain access to any organization or person's computer, software, or data without the knowledge and consent of such person (“Hacking”). The equipment and the Service may not be used in any attempt to circumvent the user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for the Customer, logging into or making use of a server or account Customer is not expressly authorized to access, or probing the security of other networks or computers for any reason. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools, is strictly prohibited;
· Impersonating others in order to obtain another user's account password or other personal information;
· Using the IP Service(s) to deliver Spyware, Adware, or secretly or deceptively obtain the personal information of third parties (phishing, etc.), or engage in modem hi-jacking;
· Using any program, file, script, command or the transmission of any message or content of any kind, designed to interfere with a terminal session or the access or use of the Internet or any other means of communication;
· Distributing or using tools designed to compromise security, including cracking tools, password guessing programs, packet sniffers or network probing tools (except in the case of authorized legitimate network security operations);
· Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network; this would include use of sniffers or SNMP tools;
· Falsifying packet header, sender, or User information whether in whole or in part to mask the identity of the sender, originator or point of origin; and
· Knowingly uploading or distributing files that contain viruses, Trojan horses, worms, time bombs, Cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
· Engaging in the transmission of pirated software, or otherwise exporting illegal software, or violating U.S. laws concerning the transmission of technical data and other regulated materials via the IP Services offered by HomeTel;
· With respect to dial-up accounts, using any software or device designed to defeat system time-out limits or to allow your account to stay logged on while you are not actively using the HomeTel IP Service(s) or using your account for the purpose of operating a server of any type;
· Using manual or electronic means to avoid any use limitations placed on the Services;
· Gaining unauthorized access to private networks;
· Violating rules, regulations, and policies applicable to any network, server, computer database, web site, or ISP that you access through the IP Service(s).
Network Usage:
No User shall excessively use Network resources on the HomeTel Network. HomeTel defines excessive usage as downloads exceeding 250 GB per month per account. Further, HomeTel reserves the right to adjust this usage limit as needed to ensure equitable use of Network capacity by other Users. HomeTel, at any time and in its sole discretion, reserves the right to disconnect any Internet Access account that causes excessive Network load or use of excessive network resources in violation of this AUP. Home Tel reserves the right to monitor the use of Network resources to ensure compliance with this policy.
Where a HomeTel Service account, service or feature description specifies limits on bandwidth, disk utilization, simultaneous connections, and/or aggregate data download or upload capacity, use in excess of those limits is not permitted without an appropriate change in account type or status, and may incur additional charges for such usage. Bandwidth, disk utilization, simultaneous connections, and aggregate data downloads/uploads will be computed or determined by HomeTel from time to time in developing its product and service offerings. In the event HomeTel determines that an account is exceeding the relevant bandwidth, disk utilization, aggregate data download/upload limits, simultaneous connections, or reasonable session times, the account owner will generally be notified by E-mail. If the excess use continues after such notification, the owner may be requested to upgrade the type of account or to modify the activity creating the excess use, or the account may be terminated. If excessive bandwidth, disk space utilization, simultaneous connections, aggregate data download or upload, or session length is determined to adversely affect HomeTel's ability to provide service, immediate action may be taken. The account owner may be notified by e-mail as soon as practical thereafter. Peak network usage is between 4 pm and 11 pm Monday – Friday and 10 am – 11 pm Saturday and Sunday. During peak usage times, priority is given to applications such as browsing, email, streaming, instant messaging, gaming and VoIP.
Congestion due to malfunctioning hardware and/or software will be remedied as quickly as network engineers can diagnose and identify the offending hardware / software. Congestion due to malice will be remedied using any technique available, including protocol-aware filtering and rate-limiting, to control and limit the offending source. HomeTel may seek criminal charges against those who inflict network malice. HomeTel may also attempt to recover costs incurred from network malice.
HomeTel will not ask you for your password in an unsolicited telephone call or email. If you believe your password has been compromised, you should immediately change your password to prevent the unauthorized use of it.
Blocking:
HomeTel shall not unjustly or unreasonably block access to lawful content, applications, services or non-harmful devices, subject to reasonable network management.
Discrimination:
HomeTel shall not unreasonably discriminate in transmitting lawful network traffic over a consumer’s broadband Internet access service, subject to reasonable network management practices.
Customer Responsibilities:
Customer remains solely and fully responsible for the content of any material posted, hosted, downloaded/uploaded, created, accessed or transmitted using the IP Services. HomeTel takes no responsibility and assumes no liability for any material created or accessible on or through the HomeTel network(s) using IP Service(s), or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity Customer (or its Users) may encounter. As the provider of IP Service(s), HomeTel is only a forum and is not liable for any statements, representations, or content provided by the users of IP Services in any public forum. HomeTel shall not be obligated to monitor or exercise any editorial control over such material, but reserves the right to do so. In the event that HomeTel becomes aware that any such material may violate this AUP, other applicable terms of use or contract provisions, and/or expose HomeTel to civil or criminal liability, HomeTel reserves the right to block access to such material and suspend or terminate the Service of any user creating, storing or disseminating such material. HomeTel further reserves the right to conduct investigations into fraud, violations of the Terms of Service, this AUP or other laws or regulations, and to cooperate with legal authorities and third parties in the investigation of alleged wrongdoing, including disclosing the identity of the user that HomeTel deems responsible for the wrongdoing. Customer agrees to indemnify and hold HomeTel harmless from any claim, action, demand, loss, or damage (including attorneys' fees) made by any third party against HomeTel as a provider of the IP Service(s) arising out of or relating to any violation(s) of this AUP by Customer (or its Users).

Important Customer Information:
In addition to the terms and conditions set forth in this AUP, service is subject to the Service Agreement, which you should read carefully before activating any Service. Incident Reporting:
Any complaints (other than claims of copyright or trademark infringement) regarding violation of this AUP by a HomeTel Customer (or its User) should be directed to HomeTel’s Policy Management Department. Where possible, include details that would assist HomeTel in investigating and resolving such complaint (i.e. expanded headers and a copy of the offending transmission).
Revisions to the AUP:
HomeTel reserves the right to modify its AUP at any time, and effective when posted to HomeTel's web site (http://www.hometel.com/internet/policies/). Notice of any change to this AUP may also be provided to a Customer via electronic mail. It is ultimately the Customer’s responsibility to notify HomeTel of any change of address. Customer must respond in a timely manner to complaints concerning misuse of the Service(s) obtained from HomeTel. Failure to responsibly manage the use of the Service(s) obtained from HomeTel may be cause for termination of Service(s) to you and, depending upon the terms under which you acquired your Service(s), could lead to the imposition of early termination fees.

PROCEDURES FOR REPORTING ABUSES TO HOME TELENETWORKS, INC.
Home TeleNetworks, Inc. (“HomeTel”) currently offers dial-up and dedicated Internet access in the St. Jacob and Highland , IL communities. We are adding more customers everyday. We appreciate the growth of our business and the support of our customers. But, there is a downside. As our number of customers has increased, we've received an increase in reports of abuses (violations of our "Acceptable Use and Network Management Policy" (AUP).
The most common abuses reported are: 1) spamming (sending bulk, unsolicited e-mail over the Internet), 2) posting or transmitting material that is harassing, threatening, or offensive, 3) posting or transmitting material that is discourteous, disrespectful or defaming; 4) posting or transmitting material that violates personal privacy and 5) the transmission of copyrighted materials.
We do not monitor every personal website and we have no intention of doing so in the future. Limitations of time and personnel make this prohibitive. We require all HomeTel subscribers to conform to our AUP in both letter and spirit. The text of our AUP is available on our home page (http://www.hometel.com). If you find any material on HomeTel’s website, or any website hosted on HomeTel’s web servers, that you believe to be inaccurate, constitutes copyright infringement or otherwise violates your intellectual property rights, we encourage you to bring it to our attention so that we may investigate. If we receive written notice that contains substantially all of the following information, we will act expeditiously to remove the material alleged to be infringing:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; and
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity that is located on HomeTel’s system or network and that is to be removed, and information reasonably sufficient to permit HomeTel to locate the material; and
4. Information reasonably sufficient to permit HomeTel to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted; and
5. A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
In addition, if you believe that you have found a site or received a transmittal that otherwise violates the AUP, the reporting procedures are as follows.
1. Notify abuse@hometel.com concerning the nature of the abuse. Please provide all pertinent information. If the abuse is on an Internet site, please provide the URL address. If the abuse is in e-mail form, please forward the e-mail to us in its entirety.
2. All complaints of abuse must be 1st person or the parent/guardian of a minor.
3. All complaints must be submitted by e-mail. No action will be taken on complaints communicated by telephone or person to person.
4. If the abuse is outside of our network, your complaint will be forwarded to the appropriate network officials. Normal response time is 48-72 hours.
5. If the abuse is within our network, your complaint will be forwarded to our network officials. Normal response time is 24-36 hours.
6. If the abuse is within our local service area, your complaint will be forwarded to our network officials. Normal response time is 24 hours. If the abuse is confirmed, the abuser will be notified to cease at once. Failure to cease abusive activity will result in termination of the account without refund.

Home Telephone Co. and its affiliates or subsidiaries (hereafter referred to as “HomeTel”) strives at all times to respect a customer's desire for privacy. We obtain and use individual customer information for business purposes only. The information is used to enable us to provide our customers with the best service possible. Customer information may also be used to protect customers, employees and property against fraud, theft, or abuse and to maintain good customer relations. Our employees are responsible for safeguarding individual customer information and communications. All personnel are aware of and protect the privacy of all forms of customer communications and information.
Privacy for Internet Service Subscribers
HomeTel does not track its user’s activities on the Internet. We monitor traffic in the aggregate in order to improve our Internet services and web site.
Proprietary Customer Information
It is the policy of HomeTel to maintain and protect the confidential and proprietary information it possesses of its customers. Unless required to do so by law or unless such information will assist HomeTel in providing telecommunications services, no customer confidential or proprietary information will be given to any third parties. For the purposes of this policy, "customer confidential or proprietary information" does not include any information published in any telephone directory.
Privacy of Information
One can visit and use our web site with complete privacy. A web site visitor can chose to provide customer-specific information by ordering a product or service, sending us e-mail or using our convenient on-line tools. Any information provided by a web site visitor is held strictly confidential by HomeTel or by its authorized agent and will not be sold or provided to any other organization or business.
Privacy of Personal Information
No personal information obtained on-line is released outside of HomeTel or by its authorized agent, except with the customer's permission, as required by law, for safety reasons, or to survey customer satisfaction. We use the information provided when placing an order to complete that order. Any information asked for on our website will only be used to process your request. We do not sell customer information to any outside party.
Internet Use
The web sites of HomeTel may contain links to other web sites. We are not responsible for the content or privacy policies of other sites. Even though we will use our best efforts to assure privacy and confidentiality, material on the web, e-mail, or other electronic communications cannot be guaranteed to be protected against access by unauthorized persons. Access by unauthorized persons can be obtained without your consent or our consent. This is simply a function of the technology in today's environment.
Data Security
To prevent unauthorized access, maintain data accuracy and ensure only appropriate use of information, appropriate safeguards have been established to secure the information collected on-line.
Updates
To improve the services we offer, the information obtained about web users may be revised in the future. This privacy statement will be updated to reflect any future developments in our Internet business practices.

I understand and agree that, subject to the terms and conditions of this Agreement, and the policies referenced herein, Home TeleNetworks, Inc. (“HomeTel”) shall provide me (the Subscriber) with certain Internet access (the Network). By accessing the Internet through the HomeTel Network, I understand that I, and/or any person using my login identification (Authorized User) explicitly and implicitly accept the terms and conditions contained in this HomeTel Internet Access Agreement (Agreement) and I agree to be bound thereby. I UNDERSTAND THAT HOMETEL RESERVES THE RIGHT TO TERMINATE THIS ACCOUNT AT ANY TIME, FOR ANY REASON.
Term and Termination:
The Subscriber agrees that this Agreement becomes effective upon registration of my login identification name and shall remain in effect for the period indicated in the rate plan selected or until terminated as provided in this Agreement. The Subscriber further acknowledge that this Agreement shall continue in effect for consecutive additional terms until either the Subscriber or HomeTel gives the other party online notice or other notice of termination at least thirty (30) calendar days prior to the expiration of the then-current term. The Subscriber understands that HomeTel reserves the right to terminate the Subscriber’s account at any time, for any reason, including, but not limited to, the Subscriber’s failure to abide by the terms of this agreement or Subscriber’s failure to pay any fees or charges when due. The Subscriber agrees that initiating two or more service cancellations and reactivations within a 12-month period may result in a $75.00 Administrative fee. If the Subscriber’s account is deactivated for non-payment, there will be a $20.00 reconnect fee charged to the Subscriber’s Account to reactive the Subscriber’s account. The Subscriber understands that violation of certain generally accepted guidelines on Internet usage, such as restrictions on mass e-mailings and mass advertising, or posting to inappropriate newsgroups, may cause severe operating difficulties for HomeTel, and would likely be a cause for termination of the Subscriber’s account. The Subscriber agrees to abide at all times by HomeTel’s then-current Usage Policies.
Provision of Service/Access:
The Subscriber understands and agrees that they are fully responsible for the use of the Network by themselves or by anyone whom they permit to use the account, and that HomeTel reserves the right to terminate the Subscriber’s account at any time, for any reason. The Subscriber understands that services may be interrupted for several reasons, including but not limited to malfunctions, maintenance, improvement, or as required to protect network resources in the event of malfunctions or misuse. Customer understands that it may not receive advance notification of any such interruption of service. Scheduled outages will be publicized online.
Subscriber Obligations:
a) The Subscriber understands that they are responsible for determining whether a HomeTel phone number is within the Subscriber’s local calling area, and for any long distance charges the Subscriber may incur in connecting to HomeTel.
b) The Subscriber understands that if they wish to cancel service with HomeTel, they may do so by calling HomeTel’s billing office at (618) 644-2211 or by sending an email to admin@hometel.com. The Subscriber understands that since HomeTel’s Internet service is unmetered the account will not be prorated. The Subscriber also understands that if they choose to disconnect service before the full month of service is up, they will be responsible for the full month of service.
c) The Subscriber understands that HomeTel reserves the right to change its services without notice including but not limited to access procedures, hours of operation, menu structures, commands, documentation, and services offered.
d) The Subscriber understands that HomeTel reserves the right to delete Subscriber's personal files which have not been accessed for more than one (1) month.
e) The Subscriber understands that they cannot use or permit other users to use the Network in ways: i) that are unlawful; or ii) infringe the rights of others; or iii) interfere with users of HomeTel’s Network or other networks; or iv) infringe upon the copyrights, trademarks or other intellectual property rights of others; or v) otherwise violate the policies referenced in this Agreement.
Security:
The Subscriber understands that the information available through HomeTel’s Network or other interconnecting networks may not be accurate, including the content displayed on the Subscriber’s desktop. The Subscriber also understands that some of the information available through HomeTel’s Network or other interconnecting networks may be intended for adult audiences. The Subscriber understands that internet communications are not secure, and may be subject to interception or loss. The Subscriber understands that HomeTel makes no warranties of any kind, whether expressed, implied, or statutory concerning either the security of data and/or information or its accuracy available through the HomeTel Network, or other interconnecting networks.
Monitoring and Compliance:
The Subscriber understands that HomeTel may, but is not required to, monitor Subscriber’s compliance, or the compliance of other subscribers, with the terms, conditions or policies of this Agreement and AUP. Subscriber acknowledges that HomeTel shall have the right, but not the obligation, to pre-screen, refuse, move or remove any content available on the Network, including but not limited to content that violates the law, this Agreement or the HomeTel Acceptable Use and Network Management Policy (AUP).
Intellectual Property:
The Subscriber may not use the network to post, copy, transmit, or disseminate any content that infringes the patents, copyrights, trade secrets, trademark, service marks or propriety rights of any party. HomeTel assumes no responsibility, and Subscriber assume all risks regarding the determination of whether material is in the public domain, or may otherwise be used by Subscriber for such purposes. The section shall in no way limit further restrictions placed on customer, including, but not limited to, state and federal law, and the “Intellectual Property” Section of the HomeTel AUP.
Restrictions on Use, Resale of Service:
The Subscriber’s access to the Network is designed for personal, non-business related use of the Internet and may not be used for commercial purposes. You may not resell (for example, though Wi-Fi or other methods of wireless or wireline networking), or otherwise charge others to use the residential Network service. You agree not to use the Network for operation as an Internet service provider, or for any other business enterprise, including, without limitation, IP address translation or similar facilities intended to provide additional access. If you subscribe to service through HomeTel’s (Broadband/DSL) Network, you may connect multiple computers/devices within a single home to your modem and/or router to access the Network, but only through a single HomeTel-issued IP address. You also may not exceed the bandwidth usage limitations that HomeTel may establish from time to time for access to the Network, or use the Network to host any type of server. Violation of this section may result in bandwidth restrictions on Subscriber’s access to the Network or suspension or termination of your service.
Pricing/Payments/Credits:
If the Subscriber has given their credit card number to HomeTel, the Subscriber understands that charges will be automatically billed to the Subscriber’s credit card each month for the basic service fee and any additional usage fees. The Subscriber expressly authorizes this automatic billing by HomeTel. The Subscriber understands that HomeTel’s monthly billing cycle runs from month to month with each period ending on the last day of each month. Payment is due by the end of the billing month. Subscribers may choose to be billed by paper, e-bill, or by credit card. The Subscriber’s account will be charged each month on their bill date for that month's service unless the bill date falls on the weekend or on a holiday. In such instances, the charge will occur on the next business day The Subscriber understands and agrees that HomeTel shall not be responsible for any charges or expenses that the Subscriber may incur resulting from overdrawing the Subscriber’s bank account or exceeding the Subscriber’s credit card limit as a result of an automatic charge generated by HomeTel pursuant to this authority. The Subscriber understands that there will be a $5.00 charge for a check returned due to insufficient funds. The Subscriber understands there shall be no credits, reductions, or setoffs against the charges for service for downtime or interruption of Service.

WARRANTY DISCLAIMER:
HOMETEL’S SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. HOMETEL DISCLAIMS ANY AND ALL WARRANTIES WITH REGARD TO THE SERVICES (WHETHER EXPRESS OR IMPLIED), INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INFRINGEMENT OR TITLE ANY WARRANTY OF QUALITY, FUNCTIONALITY, OPERABILITY, USE OR PERFORMANCE OF THE SERVICES ANY WARRANTY OF THE ACCURACY, COMPLETENESS OR VALIDITY OF THE DATA OR INFORMATION COMMUNICATED THROUGH THE SERVICES ANY WARRANTY OF THE CONTINUOUS AVAILABILITY OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE.
LIMITATIONS OF LIABILITY:
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (WHETHER TORT, CONTRACT OR OTHERWISE) SHALL HOMETEL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, LOSS OF PROFITS, GOODWILL OR INFORMATION, OR ANY OTHER PECUNIARY LOSS OR DAMAGE) ARISING OUT OF OR RELATING TO HOMETEL’S SERVICES (INCLUDING, WITHOUT LIMITATION, USE OR INABILITY TO USE THE SERVICES), EVEN IF HOMETEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL HOMETEL’S CUMULATIVE LIABILITY TO CUSTOMER EXCEED THE SERVICE CHARGES PAID BY CUSTOMER TO HOMETEL FOR THE SERVICES DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT FOR WHICH LIABILITY IS CLAIMED.
· The Subscriber understands that HomeTel is not responsible for any damages or injuries arising from Customer's use of HomeTel’s services or inability to use HomeTel’s services.
· The Subscriber understands that HomeTel is not responsible for undelivered e-mail. There is no guarantee of message receipt or delivery. Return receipts may be requested, but there is no guarantee that the recipient's e-mail system will honor such requests.
· The Subscriber understands that HomeTel is not obligated to store the contents of Subscriber's e-mail messages and is not obligated to produce copies of e-mail messages to Subscriber.
· The Subscriber understands that HomeTel is not responsible for Subscriber's personal files residing on HomeTel’s system. Subscriber is responsible for independent backup of all such data. If Subscriber exceeds the published space limitation for personal files (Web space, e-mail, FTP, etc.), HomeTel will notify the Subscriber via e-mail to reduce the file storage space. If Subscriber fails to reduce the storage space within the specified time period, HomeTel reserves the right to delete files from the Subscriber's personal space without further notice.
· The Subscriber understands that some sites accessible via HomeTel allow posting, viewing, retrieval, and/or electronic mailing of materials that may be considered obscene, offensive, inaccurate, incomplete, defamatory, harmful or objectionable. HomeTel is not responsible for Subscriber’s inadvertent or deliberate access to such material and cannot prevent access of such materials.
Choice of Law and Jurisdiction:
The Subscriber understands and agrees the laws of the State of Illinois govern this Agreement and the Subscriber’s HomeTel account. The Subscriber expressly agrees that exclusive jurisdiction for any claim or dispute with HomeTel or relating in any way to the Subscriber’s account resides in the courts of Illinois. The Subscriber further agrees and expressly consents to the exercise of personal jurisdiction in the courts of Illinois in connection with any such dispute, including any claim involving HomeTel or its affiliates, subsidiaries, employees, contractors, officers, or directors.
Indemnity:
The Subscriber agrees to defend, indemnify and hold HomeTel and its affiliates harmless from any and all liabilities, costs, and expenses, including reasonable attorneys’ fees, related to or arising from, any violation of this agreement by the Subscriber or those who access the Network through the Subscriber’s account, or the use of the Network or the Internet whether or not the Subscriber has knowledge of or have authorized such access or use, including, without limitation, claims for libel, slander, invasion of privacy, infringement of copyright, patent infringement, or other tortious behavior. The Subscriber agrees to indemnify HomeTel along with any parties from whom HomeTel obtains network services, and to hold them harmless from any claims resulting from the use of the Network by the Subscriber or any Authorized Users that damage another party or that violate the law.
Force Majeure:
HomeTel will not be liable for delays, damages or failures in performance due to causes beyond its reasonable control, including, but not limited to, acts of a governmental body, acts of God, acts of third parties, fires, floods, strikes, work slow-downs or other labor-related activity, or an inability to obtain necessary equipment or services. Subscriber understands and agrees that temporary interruptions of service may occur as normal events in the provision of service to the Network and that HomeTel is not liable for such interruptions. Subscriber further understands and agrees that HomeTel has no control over third party networks he or she may access in the course of using the Network, and therefore, delays and disruptions of other network transmissions are beyond the control of HomeTel.
Complete Agreement/Amendments:
This Agreement, when read in conjunction with the then-current published HomeTel’s Internet usage policies (incorporated herein by reference as if fully set out) represents the complete agreement between HomeTel and the Subscriber with respect to the subject matter of this Agreement, and supersedes any other written or oral agreement. The Subscriber understands and agrees that HomeTel may amend or modify this agreement and/or the HomeTel Internet usage policies, or impose new conditions at any time. Any use of HomeTel’s Network subsequent to any changes or amendments shall be deemed to constitute acceptance by the Subscriber of the then-current service agreement (including any amendments, modifications or new conditions) as published and made available via a link on the HomeTel home page.

Open Internet Disclosure for Mobile Broadband Service
Open Internet Disclosure:
The following policies apply to mass market broadband Internet services offered by Home TeleNetworks, Inc., and its affiliates or subsidiaries (all hereafter referred to as “HomeTel”). HomeTel also offers enterprise level services that can be individually tailored to customer needs. Information on enterprise services can be obtained by contacting HomeTel at (618) 644-2211. It is HomeTel’s policy to provide robust and reliable access to the Internet for all of its mass market end user customers. Because network resources are shared by all users, HomeTel discloses and identifies the following policies that govern its mass market Internet service. These policies are designed to: (i) ensure that shared network resources are allocated fairly among all users; (ii) allow users and prospective users to understand service policies and any significant limitations on the service; and (iii) provide a foundation that assures customers that they can rely on consistently receiving the level and quality of service to which they subscribe. HomeTel does not block access to, nor discriminate against, any lawful website or Internet application. Customers are encouraged to familiarize themselves with the following policies which are deemed part of their Service Agreement. By using HomeTel’s Internet service, the customer accepts, agrees to be bound by and to strictly adhere to, these policies. The customer also agrees to be responsible for compliance with these policies by third parties, such as friends, family members or guests that make use of the customer’s service accounts or equipment to access the network for any purpose, with or without the permission of the customer.
HomeTel commits to the open and non-discriminatory use of the Internet by its customers and commits to use reasonable network management practices to ensure an open Internet. HomeTel will manage its network and provide access in accordance with the Federal Communications Commission’s (FCC’s) Open Internet Rules (adopted December 21, 2010 in 25 FCC Rcd 17905) and in compliance with any future rules adopted by the FCC.
Acceptable Use:
HomeTel reserves the sole discretion to deny or restrict your service, or immediately to suspend or terminate your service, if the use of your service by you or anyone using it, in our sole discretion, violates the Service Agreement or other HomeTel policies, is objectionable or unlawful, interferes with the functioning or use of the Internet or the HomeTel network by HomeTel or other users, or violates the terms of this Acceptable Use Policy (“AUP”).
Additionally, as the underlying facilities provider for the mobile broadband service, the Acceptable Use Policy of its underlying facilities provider is also applicable to the mobile broadband service.
Specific Examples of AUP Violations:
The following are examples of conduct which may lead to termination of your Service. Without limiting the general policy above, it is a violation of the Agreement and this AUP to:
· Access without permission or right the accounts or computer systems of others, to spoof the URL, DNS or IP addresses of HomeTel or any other entity, or to penetrate the security measures of HomeTel or any other person's computer system, or to attempt any of the foregoing;
· Transmit uninvited communications, data or information, or engage in other similar activities, including without limitation, "spamming", "flaming" or denial of service attacks;
· Intercept, interfere with or redirect email or other transmissions sent by or to others;
· Introduce viruses, worms, harmful code or Trojan horses on the Internet;
· Post off-topic information on message boards, chat rooms or social networking sites;
· Engage in conduct that is defamatory, fraudulent, obscene or deceptive;
· Violate HomeTel's or any third party's copyright, trademark, proprietary or other intellectual property rights;
· Engage in any conduct harmful to the HomeTel network, the Internet generally or other Internet users;
· Generate excessive amounts of email or other Internet traffic;
· Use the service to violate any rule, policy or guideline of HomeTel;
· Use the service in any fashion for the transmission or dissemination of images containing child pornography or in a manner that is obscene, sexually explicit, cruel or racist in nature or which espouses, promotes or incites bigotry, hatred or racism; or
· Download or use the Service in Cuba, Iran, North Korea, Sudan and Syria or in destinations that are otherwise controlled or embargoed under U.S. law, as modified from time to time by the Departments of Treasury and Commerce.
Copyright Infringement/Repeat Infringer:
HomeTel respects the intellectual property rights of third parties. Accordingly, you may not store any material or use HomeTel's systems or servers in any manner that constitutes an infringement of third party intellectual property rights, including under US copyright law. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, it is the policy of HomeTel to suspend or terminate, in appropriate circumstances, the service provided to any subscriber or account holder who is deemed to infringe third party intellectual property rights, including repeat infringers of copyrights. In addition, HomeTel expressly reserves the right to suspend, terminate or take other interim action regarding the service of any user or account holder if HomeTel, in its sole judgment, believes that circumstances relating to an infringement of third party intellectual property rights warrant such action. These policies are in addition to and do not affect or modify any other rights HomeTel may have under law or contract. If you believe that copyrighted material has been used in violation of this policy or otherwise been made available on the service in a manner that is not authorized by the copyright owner, its agent or the law, please contact HomeTel’s Policy Management Department whose contact information is listed below.
HomeTel may, but is not required to, monitor your compliance, or the compliance of other subscribers, with the terms, conditions or policies of the Service Agreement and AUP. You acknowledge that HomeTel shall have the right, but not the obligation, to pre-screen, refuse, move or remove any content available on the service, including but not limited to content that violates the law or this Agreement.
Network Management:
All traffic management for the mobile broadband service is controlled by its underlying facilities provider. Accordingly, HomeTel’s mobile broadband service adheres to the network management practices of its underlying facilities provider.
Device Attachment:
HomeTel’s device attachment rules and restrictions are consistent with the device attachment rules and restrictions of its underlying facilities provider.
Except as disclosed herein, HomeTel does not impose any further device attachment rules or limitations in addition to those of its facilities provider.
Privacy:
While HomeTel collects personally identifiable information in order to provide the mobile broadband service and to bill for this service, HomeTel does not collect any information concerning the customer’s visited websites, application usage or other Internet activity. However, customers should be familiar with the privacy policies of HomeTel’s underlying facilities provider.
Commercial Pricing:
Please contact HomeTel for pricing information including monthly prices, usage-based fees, and fees for early termination or additional network services.
Minimum Terms:
· Your service order indicates whether you have agreed to a minimum service term for your service and, if so, the number of months in the term. YOU WILL BE SUBJECT TO AN EARLY TERMINATION FEE IF YOU CANCEL SERVICES BEFORE THE END OF THE MINIMUM SERVICE TERM (OR IF WE TERMINATE YOUR SERVICE EARLY FOR CAUSE UNDER THE AGREEMENT). The Early Termination Fee, which is noted on your service order, will decrease by $6.25 for each month of the minimum service term that you complete.
· If your service plan does not include a minimum service term or, if it does and you reach the end of the minimum service term, your service term will be “month-to-month” and will not be subject to an Early Termination Fee if you cancel your service.
· If your service term is month-to-month, HomeTel can change the price of your service by providing you at least one billing cycle’s notice of the change.
Maximum Monthly Data Caps:
· Your service order indicates whether you are subject to a maximum monthly data cap on your service. The cap states the aggregate number of megabytes of data that you may send and receive using the service in a single billing cycle. If your use of the services exceeds the cap in any billing cycle, you will be subject to an additional charge of 0.0002 per KB. The amount of this charge appears on your service order.
· It is each customer’s responsibility for keeping track of his or her data use. HomeTel makes current data usage information available to its customers. You may track your usage by visiting http://209.117.79.47:8011/enduser/Login/tabid/597/Default.aspx. Unused data in a given billing cycle does not “roll over” to future billing cycles.
Changing or Cancelling Service:
· If you cancel your service, in addition to any applicable Early Termination Fee, you must pay for your use of the service up until the date on which you cancelled, including charges for exceeding any data cap that applied to your account, and applicable taxes.
· If, during the minimum service term, you decide to change to another HomeTel service plan (for example, one with different rates or usage allowances) or to add additional services, such as international roaming, to your plan, then HomeTel has the right to restart the minimum service term from the beginning of the change in plan or addition of service.
· If, during the minimum service term, HomeTel changes the terms of your service and the changes are materially disadvantageous to you, you may terminate the service without paying an Early Termination Fee by providing written notice to HomeTel within thirty (30) days of the effective date of the change.
Redress:
All end users and edge providers that have questions or complaints regarding HomeTel’s mobile broadband service should contact admin@hometel.com, 618?644?2211 or 618?651?9308. An “edge provider” refers to any content, application, service, and device provider, which generally operates at the edge rather than the core of the network.
Incident Reporting:
Any complaints (other than claims of copyright or trademark infringement) regarding violation of this AUP by a HomeTel Customer (or its User) should be directed to HomeTel’s Policy Management Department. Where possible, include details that would assist HomeTel in investigating and resolving such complaint (i.e. expanded headers and a copy of the offending transmission).
Revisions to the AUP:
HomeTel reserves the right to modify its AUP at any time, and effective when posted to HomeTel’s web site (http://www.hometel.com/internet/policies/). Notice of any change to this AUP may also be provided to a Customer via electronic mail. It is ultimately Customer’s responsibility to notify HomeTel of any change of address. Customer must respond in a timely manner to complaints concerning misuse of the Service(s) obtained from HomeTel. Failure to responsibly manage the use of the Service(s) obtained from HomeTel may be cause for termination of Service(s) to you and, depending upon the terms under which you acquired your Service(s), could lead to the imposition of early termination fees.
